Is Hilary Duff's Divorce About To Get Messy?

There's a good chance this is no cause for alarm, so I won't ring the warning bells just yet. However, E! Online reports that Mike Comrie is fighting Hilary Duff for join custody of their son Luca, depending on your definition of fighting. When Duff initially filed her divorce papers, she asked for primary custody of Luca with visitation rights for Comrie; now Comrie has filed his actual response to the papers, and it turns out that he wants joint legal and physical custody instead. Thus far, Comrie and Duff have proven to be the very definition of amicable exes, though not to Gwyneth Paltrow and Chris Martin levels, but does that mean we might be able to avoid trouble brewing between the formerly happy couple?

I'm keeping my fingers crossed that the answer there is yes. After all, as Duff said in a statement released when the divorce came to light, "They remain best friends and will continue to be in each other's lives. They are dedicated to loving and parenting their amazing son, and ask for privacy at this time." To go from that to being entrenched in a vicious custody battle over their 3-year-old doesn't seem like Duff and Comrie's style.

At the same time, there is a lot of potential for disagreement here. After all, Duff filed for one thing and now Comrie is belatedly filing for another. Did something change between the time she drew up her papers and the time he drew up his? Or did they just never talk about which path would be the best for their son before Duff filed to begin with? That bit of uncertainty could lead to some friction between the separated couple, although I have absolutely no doubt that they will work it out in a way that is most beneficial to their son. If there's one thing that's impossible to question, it's Duff and Comrie's love and dedication toward Luca.

Like I said, a vicious custody battle is just not this low-key pair's style, especially not when you consider the effect it would have on their son. However they resolve this, it will probably be in the same amicable way that they went through the process of separating and remaining on good terms afterward. As interesting as it is to try and kick up conflict between Duff and Comrie, it's better to do as they asked us to do so long ago and give them some privacy during this time.
