Luann de Lesseps Has Been Officially Charged With A Felony For Her Arrest

On Wednesday, Real Housewives of New York City star Luann de Lesseps was charged with a third-degree felony for allegedly resisting an officer with violence in relation to her December arrest, according to documents obtained by Bustle from the State Attorney for Palm Beach, Florida. In addition, she has been charged with a misdemeanor in the first degree for allegedly trespassing in an occupied structure or conveyance and a misdemeanor in the second degree for alleged disorderly intoxication. Bustle has reached out to a rep for de Lesseps for comment regarding the charges, but did not receive a response at the time of publication.

The Florida Department of Corrections and the Florida Legislature state that a third-degree felony carries a sentence of no more than five years in prison. As for the misdemeanor charges, the Florida Legislature states that misdemeanor in the first degree carries a prison sentence of no more than one year and a misdemeanor in the second degree carries a prison sentence no more than 60 days.

On Dec. 23, the Real Housewife was arrested by Palm Beach Police. At the time, the Palm Beach County Sheriff's Office confirmed (via People) de Lesseps was charged with alleged disorderly intoxication, battery on an officer/firefighter/EMT, resisting arrest with violence, and threatening a public servant.

Bustle obtained de Lesseps' police report from the Palm Beach Police, which read the 52-year-old reality star and a male friend allegedly entered the wrong hotel room at the Colony Hotel in Palm Beach, Florida. She had another room booked at the same hotel, but it's unclear why she allegedly entered the wrong room. According to the police report, a security guard allegedly tried to get de Lesseps and her male friend to leave, but was unsuccessful and ended up contacting authorities.

At some point, according to the police report, de Lesseps allegedly locked herself in the bathroom, refused to leave the hotel room, and eventually opened the bathroom door. She then allegedly shoved the security guard in the chest and resisted arrest. Bustle reached out de Lesseps' rep for comment regarding the police report, but did not receive a response.

After she was arrested, de Lesseps allegedly slipped out of handcuffs and tried to escape from the police car. The arresting officer allegedly had to take her out of the car and place the handcuffs back on her, according to the police report. She also allegedly resisted during this time and allegedly yelled, "I'm going to f*cking kill you." The police report further states that de Lesseps allegedly tried to hold the police car door open by kicking it and the police officer had to physically place her back in her seat.

According to a report from the Palm Beach Post, de Lesseps was released on her own recognizance by noon on Dec. 24.

After her arrest, de Lesseps released a statement on Twitter. "I want to offer my most sincere apologies to anyone that I might have offended with my behavior," she tweeted. "This was my first time in Palm Beach since my wedding and being here brought up buried emotions. I am committed to a transformative and hopeful 2018."

De Lesseps confirmed to People that she was entering rehab following her arrest. "After the events of last Saturday night in Palm Beach, I am truly embarrassed," her Dec. 29 statement read. "I have decided to seek professional guidance and will be voluntarily checking into an alcohol treatment center."

She returned home from rehab in late January, according to a Jan. 23 tweet she posted. "It’s good to be home," her tweet read. "I’m doing great. Spending time with friends and family. Thanking everyone for your continued good wishes and support."

According to E! News, and as confirmed to Bustle by the State Attorney's office, on Jan. 2, de Lesseps entered a plea of not guilty to all the charges. In December 2017, People reported that she has a court date set for Tuesday, Jan. 25.
