No funny business for Tracy Morgan, who is suing Walmart for the car crash that killed one person and injured seven others. The 30 Rock comedian suffered intense personal injuries that left him in critical condition. He has since improved enough to be moved to a rehab center and continue his extensive recovery.
The crash was found to be caused by an exhausted driver of a Walmart van who had not slept in over 24 hours. Federal law regulates that truck drivers must take a 10-hour break between shifts, but rather than sue Kevin Roper, the man in question, Morgan is going after the company itself. The suit filed reads as such:
Wal-Mart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries. As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.
Walmart is no stranger to complaints and has been called "the nation's most popular private-sector target for lawsuits." At one point the business was being sued "once every two hours, every day of the year." Needless to say the company is used to this kind of thing, and have already released its counter-statement, saying, "We are deeply sorry that one of our trucks was involved ... but we're committed to doing the right thing for all involved."
While the lawsuit gets underway, Morgan will continue his rehabilitation in hopes of getting better and working on his new untitled series for the FXX channel. The network has said the job is there waiting for Morgan whenever he is well enough to take it.
